ALL CANDIDATES MUST:

Be a qualified elector (registered voter) of the State of Mississippi and of the district, county or municipality of the office for which he seeks election;

Never have been convicted of bribery, perjury or other infamous crime, being a crime punishable by a minimum of one (1) year confinement in the state penitentiary, i.e., all felonies, unless pardoned for the offense, Miss. Const. of 1890, Article IV, § 44; and

Never have been convicted of a felony in a court of this state, or, on or after December 8, 1992, of a felony in a federal court, or of an offense in the court of another state which is a felony under the laws of this state, as provided in Section 44 of the Mississippi Constitution; excluding, however, convictions of manslaughter and violations of the United States Internal Revenue Code or any violations of the tax laws of this state, unless the offense also involved the misuse or abuse of an office or money coming into a candidate’s hands by virtue of an office.

All signatures on petitions for independent or special election candidates MUST be certified by the signer’s circuit or municipal clerk respectively before filing with the appropriate office.

Independent Candidates’ nominating petitions, containing signatures of not less than 1,000 qualified electors of this state, must also be accompanied by a list of Presidential electors including the electors’ addresses and signed electors’ certificates and submitted with a qualifying fee of $2,500 to the Secretary of State’s Office.Miss. UNITED STATES SENATOR   ​​​    ​​​

Each senator must be at least 30 years old, must have been a citizen of the United States for at least the past nine years, and must be, at the time of the election, an inhabitant of the state they seek to represent. U.S. Const., Art. 1, § 3.

Political Party Candidates submit a Statement of Intent and a $1,000 qualifying fee to the appropriate state party executive committee.

Independent Candidates file a Statement of Intent, petition containing signatures of not less than 1,000 qualified electors of the state and a $1,000 qualifying fee to the Secretary of State’s Office. 
UNITED STATES REPRESENTATIVE   

Each congressional district shall be entitled to one (1) representative, who shall have attained the age of twenty-five (25) years, and been seven (7) years a citizen of the United States, and who shall, when elected, be an inhabitant of the state. Miss. Code Ann. §23-15-1035.

Political Party Candidates submit a Statement of Intent and a $500 qualifying fee to the appropriate state party executive committee.

Independent Candidates file a Statement of Intent, petition containing signatures of not less than 200 qualified electors of the district and a $500 qualifying fee to the Secretary of State’s Office. 
 

Special Election: Candidates qualifying to run as an independent candidate for House of Representatives in a special election must file a qualifying statement of intent and a petition with the Secretary of State containing signatures of not less than 1,000 qualified electors of the congressional district. The petition shall be filed by 5:00 pm not less than fifty (50) days before the date of the election. There shall be attached to each petition, at the time of filing with the Secretary of State, a certificate from the appropriate registrar or registrars showing the number of qualified electors appearing upon each petition which the registrar shall furnish to the petitioner upon request. Miss. Code Ann. §23-15-853.

A candidate shall be a qualified elector of the district in which election is sought, and have a high school diploma or its equivalent. Must be a resident of the county district in which he/she seeks election for two (2) years preceding the day of election. Miss. Const. of 1890, Art. VI, §171 and Art. XII, §250Miss. Code §§§37-5-1, 37-7-306,23-15-300. 

All candidates file a Statement of Intent and petition containing the signatures of not less than 50 qualified electors of the district with the Circuit Clerk.  No qualifying fee is paid. 
LEVEE COMMISSION    

A qualified elector in the county and district in which he/she seeks election. Must be a resident of the county district in which he/she seeks election for two (2) years preceding the day of election.  Miss. Code Ann. 23-15-300.

Political Party Candidates submit a Statement of Intent to the appropriate county party executive committee via the Circuit Clerk. No qualifying fee is paid.

Independent Candidates and Special Election Candidates file a Statement of Intent, and a petition containing signatures of not less than 50 qualified electors of the district to the Circuit Clerk. No qualifying fee is paid.

  
MUNICIPAL OFFICES

MAYOR       ​​​​​All candidates must meet the following additional requirements to qualify for office: Qualified elector (registered voter) of the State of Mississippi in the municipality of the office for which the candidate seeks election; Resident of the municipality that he/she seeks to represent for two (2) years immediately preceding the day of the election (Miss. Code Ann. §23-15-300); Never have been convicted of bribery, perjury or other infamous crime, being defined as a crime punishable by confinement in the penitentiary (unless the candidate received a full pardon); Never have been convicted of a felony in federal court after December 8, 1992, nor of a crime in the court of another state which is a felony in this state, after December 8, 1992, as provided in Section 44 of the Mississippi Constitution. A candidate is not required to be a resident of the municipality that he/seeks to represent for two (2) years immediate preceding the election if the municipality has less than one thousand (1,000) residents according to the latest federal decennial census.

A political party candidate must submit two items to the Municipal Clerk’s office: (1) a filing fee of ten dollars ($10.00) by 5:00 p.m. at least sixty (60) days prior to the primary election and, (2) a written Statement of Intent containing the name and address of the candidate, the name of the party with which the candidate is affiliated, and the office the candidate is seeking (Miss. Code Ann. § 23-15-309 (1972)). The Municipal Clerk must forward the Statement of Intent and the filing fee to the Secretary of the proper Executive Committee. The forms are available at your Municipal Clerk’s Office, Municipal Party headquarters, and the Secretary of State’s Office. Independent candidates do not pay a qualifying fee. To qualify as an independent candidate in a municipal general election, a candidate must file a petition with the Municipal Clerk by 5:00 p.m. on the same day that candidates in Primary Elections must qualify, i.e., at least sixty (60) days prior to the first primary election (Miss. Code Ann. §§ 23-15-361 and 23-15-309 (1972)). The petition must be signed by at least fifty (50) qualified voters of a municipality or ward, if the municipality or ward has a population of one thousand (1,000) residents or more. The petition must be signed by at least fifteen (15) qualified voters of a municipality or ward, if the municipality or ward, has a population of fewer than one thousand (1,000) residents (Miss. Code Ann. § 23-15-361 (1972)). The Municipal Clerk must certify that the signatures are those of registered voters in the municipality. Petitions are available at the Municipal Clerk’s Office, the Secretary of State’s Office.​

Independent Candidates file a Statement of Intent and petition containing the signatures of not less than 50 qualified electors of the municipality, if the municipality has a population of 1,000 residents or more, of not less than 15 qualified electors of the municipality, if the municipality has a population of less than 1,000, with the Municipal Clerk.  Miss. Code Ann.

§ 23-15-361.  If the office sought is elected by ward or district, the petition must contain the signatures of not less than 50 qualified electors of the ward/district, if the ward/district has a population of 1,000 residents or more, or of not less than 15 qualified electors of the ward/district, if the ward/district has a population of less than 1,000.

MUNICIPAL SEPARATE SCHOOL DISTRICT ​         ​​​​​ A candidate shall be a qualified elector of the district in which election is sought, and have a high school diploma or its equivalent. Must be a resident of the district in which he/she seeks election for two (2) years preceding the day of election. Miss. Const. of1890, Art. XII, §250; Miss. Code §§§ 37-7-201, 37-7-203, 37-7-30623-15-300.
All candidates file a Statement of Intent, Affidavit of the Candidate and petition containing the signatures of not less than 50 qualified electors of the district with the Circuit Clerk.  If there are less than one hundred (100) qualified electors of the area to be represented, the petition must contain the signatures of not less than 20% of the qualified electors of the area. No qualifying fee is paid.                                                               
CONSOLIDATED LINE SCHOOL DISTRICT TRUSTEE      

A candidate shall be a qualified elector of the district in which election is sought, and have a high school diploma or its equivalent.Must be a resident of the district in which he/she seeks election for two (2) years preceding the day of election. Miss.
